FAQs regarding Citizenship By Descent
Who can claim Canadian citizenship by descent
In December 2025, the Canadian government made changes to its Citizenship Law, that allows people to claim Canadian citizenship based on ancestry. There is no limit to how many generations ago an ancestor left Canada. We have filed multiple applications where an ancestor left Canada before 1900.
Do I need to take an language test to be eligible?
No. The eligibility depends on the applicant being able to prove a line of descent. There are various ways to do that. We help our clients determine the right way to prove Canadian lineage.
How long does the process take?
It depends. If the applicant already has collected most of the required documents, specifically proving lineage, we take about 4 weeks to submit an application. The current processing time from the Canadian government to provide a citizenship certificate is around a year. This timeline can increase as more and more applicants apply for this pathway.
If I have a Canadian ancestor, will my spouse also be eligible to apply with me?
No. Under this pathway, Canadian lineage is a must. If you have Canadian lineage, your children born before 15 December 2015, are eligible. But your spouse is not. Once you get your citizenship certificate, you may apply for your spouse’s Canadian permanent residence based on that.
